Spain Opens Second Round of Consultation on Crea y Crece E-Invoicing Regulations

As part of its ongoing digital transformation in taxation, Spain opened a second round of public consultation on the Draft Royal Decree “Crea y Crece.” The initiative is a significant step in the country's push to modernize business transactions through mandatory electronic invoicing.

Key Regulatory Updates Under Review


A key proposed change is replacing the current Facturae format with the Universal Business Language (UBL) format as the new standard for public e-invoicing. This shift would align Spain with the European Union’s broader VAT in the Digital Age (ViDA) reforms.

Other regulatory updates being considered include:

  • Clearer guidelines on how to handle credit and debit note payments, along with defined methods for calculating payment deadlines, including their start and end points
  • Assurance that invoices issued through the public platform will adhere to VERI*FACTU standards;
  • Updates concerning the handling of ‘true copies’ within private e-invoicing networks.

Implementation Timeline


While the exact implementation is yet to be confirmed, a phased rollout is planned:

  • For businesses with annual revenues above €8 million, compliance will be required no earlier than one year after the ministerial order is approved.
  • For all others, the obligation would begin two years after approval – assuming relevant EU regulatory exemptions are granted or no longer required.

Technical documentation is currently under development and will go through its own public review process. In the meantime, companies are advised to stay alert for further details regarding the official implementation timeline.
